Application for revocation of coverage of the Dawson Valley Pipeline

On 15 May 2014 the National Competition Council received an application under the National Gas Law (NGL) from WestSide Corporation for revocation of coverage of the Dawson Valley Pipeline in Queensland. This pipeline extends from the Dawson River Gas Processing Facility and interconnects to the Queensland Gas Pipeline at the Jemena Moura meter station. The pipeline also connects to the Queensland Nitrates Plant at Moura. A copy of the public version of the application is available for download under the Application tab.

The Council is undertaking a public consultation on the application in accordance with the standard consultative procedures (rule 8 of the National Gas Rules). Under this procedure, in normal circumstances, the Council has 4 months in which to make its recommendation.

The Council invited interested parties to make written submission on the application by no later than 13 June 2014. The Council received no submission on the application.

On 26 June 2014 the Council released its draft recommendation which is available for download under the Draft recommendation tab. Interested parties were invited to make written submissions on the draft recommendation before Monday 21 July 2014. The Council received one submission (plus two attachments) from the applicant, Westside Corporation Ltd in response to the Draft Recommendation. On the basis that the Dawson Valley Pipeline is located wholly within Queensland, the relevant Minister will be the Commonwealth Minister for Industry, Hon. Ian Macfarlane MP.

On 4 August 2014 the Council provided its final recommendation to revoke coverage of the Dawson Valley pipeline to Minister Macfarlane. A copy of the final recommendation can be downloaded under the Final recommendation and decision tab. Under the NGL the Minister is required to use his best endeavours to make his decision within 20 business days.

On 8 September 2014 the Council received Minister Macfarlane’s decision and statement of reasons.  The Minister's decision was to make a coverage revocation determination for the Dawson Valley Pipeline.
