Application for declaration of shipping channel services at the Port of Newcastle (Final recommendation and decision)
On 10 November 2015, the Council sent to the Federal Treasurer, the Hon. Scott Morrison MP, its final recommendation in respect of the application by Glencore Coal Pty Ltd for declaration of the shipping channel service at the Port of Newcastle.
Under s 44H(9) of the Competition and Consumer Act 2010 (Cth), if the Minister has not published his decision and the reasons for his decision within 60 days after receiving the Council’s recommendation, he will be deemed to have decided not to declare the service.
The Acting Treasurer, Senator the Hon. Mathias Cormann, made a decision on 8 January 2016, which was published on the NCC website on 11 January 2016. The Minister’s decision was not to declare the service. The Minister’s decision and the Council’s final recommendation are available below.
