Application for certification of the Dalrymple Bay Coal Terminal access regime (Application)

On 18 January 2021, the Council received an application under section 44NA of the Competition and Consumer Act 2010 from the Premier of Queensland, the Hon Annastacia Palaszczuk MP, for certification of the Dalrymple Bay Coal Terminal access regime.

Certification is sought for coal handling services at the Dalrymple Bay Coal Terminal. The Dalrymple Bay Coal Terminal access regime was previously certified on 11 July 2011 as an effective access regime for a period of ten years. The applicant requests that the Council recommend to the Commonwealth Minister that the regime be certified for a further period of ten years.

The Council invited interested parties to make written submissions on the application by Friday 19 February 2021.

After considering submissions on the application, the Council will release a draft recommendation and provide a further opportunity for public comment before making its final recommendation to the Commonwealth Minister.

On 7 May 2021, the Council wrote to the Treasury to advise of a likely delay in meeting the statutory deadline for consideration of this application. A copy of the letter is available below.
