Application for certification of the South Australian ports access regime

On 15 October 2010 the Council received an application from the Premier of South Australia, the Hon Mike Rann MP, under s44M of the Trade Practices Act (TPA) for the certification of the South Australian ports access regime established under the Maritime Services (Access) Act 2000 (SA).  A copy of the application and legislation is available under the Application tab to the left.

The Council invited written submissions on the application from interested parties.  The submission period ended on 22 November 2010, and the Council received three submissions which are available for download under the Submissions on application tab.  

Shortly after the close of the submission period, the Council received a submission from Ports Australia. The Council accepted this submission as it was able to publish the submission on the same day as the submissions received by the closing date.

The Council released its draft recommendation on the 13 January 2010 which is available under the Draft recommendation tab. The Council's proposed recommendation to the Commonwealth Minister is that the Regime be certified as effective for a period of 10 years.

The Council invited written submissions on the draft recommendation with the submission period ending on Friday 18 February 2011.  One submission was received which is available for download under the Submission on draft recommendation tab.

On 10 March 2011 the Council provided its final recommendation to the Commonwealth Minister, the Parliamentary Secretary to the Treasurer, the Hon David Bradbury MP. 

On 9 May 2011 the Commonwealth Minister, the Parliamentary Secretary to the Treasurer, the Hon David Bradbury MP, made his decision to certify the South Australian Ports Access Regime as an effective access regime for a period of ten years.  The decision is consistent with the Council's final recommendation.
