Application for certification of the South Australian rail access regime (Draft recommendation)

On 16 March 2011 the Council released its draft recommendation on the application for certification of the South Australian Rail Access Regime. The Council's preliminary proposed recommendation to the Commonwealth Minister is that the Regime be certified as effective for a period of five years. The Council would likely recommend that the Regime be certified for 10 years in its final recommendation should the South Australian Government formalise certain arrangements for periodic review, as discussed in the draft recommendation.

The Council now invites written submissions on the draft recommendation from interested parties. As noted in the Council's Guide to Making a Submission, (available under the Application tab to the left) submissions on a draft recommendation should focus on the preliminary conclusions reached by the Council and the reasons for these and seek to provide additional information and analysis to that already available to the Council. Repetition of points that have been made earlier is unlikely to be of assistance. The closing time and date for submissions is 5.00pm on Monday 18 April 2011.

The Council will consider the submissions in developing its final recommendation to the Commonwealth Minister who will decide whether or not to certify the Regime as effective.
