Access regulation seeks to promote effective competition in markets that depend on using the services of infrastructure that cannot be economically duplicated.

Application for 15 year no-coverage determination - Comet Ridge to Wallumbilla Pipeline Loop (CRWPL)

On 12 February 2015 the Council received an application under section 151 of the National Gas Law (NGL) from GLNG Operations Pty Ltd for a 15 year no-coverage determination in relation to a proposed natural gas pipeline that will run between Comet Ridge and Wallumbilla in Queensland. On 1 June 2015 the Council received the relevant Minister's determination and statement of reasons. The relevant Minister has decided to make a no-coverage determination for the CRWPL in accord with the Council's final recommendation.

Application for declaration of shipping channel services at the Port of Newcastle

The Council has received an application under Part IIIA of the Competition and Consumer Act 2010 (CCA) from Glencore Coal Pty Ltd seeking declaration provision of the right to access and use the shipping channels provided by the Port of Newcastle. On 30 July 2015 the Council released its draft recommendation. The draft recommendation is that the service not be declared. The Council invites written submission from interested parties on the draft recommendation by 5:00pm on Monday 31 August 2015.
