Guides and templates

The Council intends to update its Guides to reflect recent legislative changes and other developments, in particular those resulting from the passage of the Trade Practices Amendment (Infrastructure Access) Act 2010 and the Competition Tribunal's decisions in relation to the declaration of various Pilbara iron ore railways.

The Council expects these updates will be available within three months.

Until these updates are completed there is a heightened risk that some parts of the Guides may not reflect recent amendments or represent the Council's current approach to particular issues. 14 July 2010

Template for applications for declaration

The Council's template for applications for declaration of infrastructure services under Part IIIA of the Trade Practices Act 1974 (Cth) sets out the information that should be included in an application for declaration.

The Council encourages all applicants for a recommendation for declaration to use the template. The template should assist parties to prepare a comprehensive application that fully addresses the Trade Practices Act criteria and other factors that must be considered before a declaration can be made. By gathering this information at the time an application is made, the Council is looking to streamline the time taken to consider applications. This template adds greater specificity to the information requirements set out in Regulation 6A of the Trade Practices Regulations 1974 (Cth).
